New Regulations for Goods Vehicles in Europe: A Guide
As of May 2022, vehicles transporting goods for hire or reward across Europe, including cars with trailers that have a gross combination weight exceeding 2.5 tonnes, must be listed on an international Operator’s Licence. This requirement also necessitates that the undertaking employs a professionally competent Transport Manager.
Existing Operators
For businesses already operating heavy goods vehicles in the EU, the process is straightforward.
The new vehicles can be added to the existing Operator’s Licence under the current Transport Manager, provided that the total number of vehicles does not surpass the limit outlined in Statutory Document 3 for Great Britain (GB) or Practice Guidance Document 3 for Northern Ireland (NI).
If the vehicle count exceeds these limits, an additional Transport Manager will be required.
New Undertakings
For new businesses that fall under this regulation, obtaining an Operator’s Licence will be necessary. This process will include hiring a Transport Manager who meets the required professional qualifications.
Temporary Recognition of Transport Managers
When the regulation was first introduced, the government provided an interim measure allowing businesses operating light goods vehicles to temporarily recognise an existing staff member as a Transport Manager. However, this concession ended on 21 May 2024.
Those who gained temporary recognition can continue in the role until 21 May 2025 but must pass the Transport Manager’s Certificate of Professional Competence (CPC) to remain in the position beyond that date.
Professional Competence Requirements
If a business does not meet the criteria for the temporary concession, or if the temporary Transport Manager does not achieve professional competence by the deadline, the business must hire or contract a qualified Transport Manager. The Transport Manager must hold a valid CPC qualification.
For businesses that opt to contract an external Transport Manager, the agreement must include a signed contract outlining the manager’s duties.
An external Transport Manager can serve up to four operators, provided that the combined number of vehicles does not exceed 50.
Compliance for International Journeys
For drivers embarking on international journeys, it is mandatory to carry the UK Licence for the Community.
This document is issued when the vehicle is listed on an international Operator’s Licence and serves as proof that the vehicle is compliant with the necessary regulations.
